This Public Contract (hereinafter referred to as the "Contract") determines the procedure for the provision and receipt of ticket booking and sales services, regulates relations between the Site Owner, the Technology Provider, the End Consumer, and the Carriers. Within the meaning of Art. 633 of the Civil Code of Ukraine, this Contract is a public contract.
Before using the site, please read the Contract carefully. If you do not agree with the terms set forth, please do not use the site https://kvytky.com.ua/.
The public offer contract, rules, and conditions may be changed without prior notice. Changes take effect from the moment of their publication on the site. Your booking and/or payment of a ticket is evidence of your unconditional acceptance of this Contract.

In this Contract, the terms are used in the following meaning:
End Consumer (User) – an individual or legal entity that visits the Site and directly uses the ticket booking/purchase services.
Site Owner (Agent) – PP "Liliya Capital" (USREOU code [Insert code]), which manages the site https://kvytky.com.ua/, provides booking execution services, makes settlements with Users, and provides customer support.
Technology Provider – LLC "MOBILITY UKRAINE" (USREOU code 44422062), a legal entity that is the developer and owner of the rights to the Booking and Sales System (BSS) and transport content. The Technology Provider grants the Site Owner access to the BSS under the terms of a separate B2B contract and does not enter into direct financial or legal relations with the End Consumer regarding the purchase of tickets.
Carrier – a legal entity or individual entrepreneur that directly provides passenger and baggage transportation services.
Booking and Sales System (BSS) – a software and hardware complex developed and owned by LLC "MOBILITY UKRAINE", designed for searching, booking, and generating electronic travel documents.
Ticket – a travel document of the established form, generated in the BSS, which gives the passenger the right to receive transport services directly from the Carrier.
Carrier – a legal entity or individual entrepreneur that directly provides passenger and baggage transportation services.
Booking and Sales System (BSS) – a software and hardware complex developed and owned by LLC "MOBILITY UKRAINE", designed for searching, booking, and generating electronic travel documents.
Ticket – a travel document of the established form, generated in the BSS, which gives the passenger the right to receive transport services directly from the Carrier.
GENERAL PROVISIONS
The Site Owner carries out economic activities using the internet site domain https://kvytky.com.ua/, using a technological solution (API/BSS) provided by the Technology Provider. This Contract is an official offer of the Site Owner. By making a payment, the User accepts the offer and concludes a contract with the Site Owner for the provision of information and agency services, as well as a contract of carriage — directly with the Carrier or through the Technology Provider.
SUBJECT OF THE CONTRACT
1.1. Under this Contract, the Site Owner undertakes to provide the End Consumer with information and intermediary services: searching for the relevant Carrier, booking execution, and sale of Tickets using the technological platform (BSS).
1.2. The Technology Provider (LLC "MOBILITY UKRAINE") ensures exclusively the technical operability of the BSS and the transfer of transport content to the Owner's Site, acting exclusively as a software developer and IT service provider for the Site Owner.
2. RIGHTS AND OBLIGATIONS OF THE PARTIES
2.1. The End Consumer has the right:
2.1.1. To receive booking services through the Site.
2.1.2. To use the Ticket in accordance with the terms of the selected Carrier.
2.1.3. To return the Ticket under the Carrier's conditions by contacting the support service of the Site Owner (PP "Liliya Capital").
2.1.4. To submit complaints and claims regarding the operation of the Site and financial settlements exclusively to the Site Owner.
2.2. The End Consumer is obliged:
2.2.1. To independently verify the entered data (date, time, route, full name) prior to payment.
2.2.2. To pay the Ticket price to the Site Owner.
2.2.3. To familiarize themselves with the Ticket return conditions of the specific Carrier prior to payment.
2.3. The Site Owner (PP "Liliya Capital") has the right:
2.3.1. To charge a service fee for its own ticket execution services.
2.3.2. To make changes to the Site interface.
2.4. The Site Owner is obliged:
2.4.1. To provide the User with the ability to execute and pay for the Ticket.
2.4.2. To send the generated Ticket to the End Consumer.
2.4.3. To receive and process all requests, complaints, and refund requests from End Consumers.
2.4.4. To make financial settlements with Carriers (independently or through authorized agents).
2.5. The Technology Provider (LLC "MOBILITY UKRAINE") has the right:
2.5.1. To temporarily suspend access to the BSS for scheduled maintenance or repair work.
2.5.2. To change the operating algorithms of the BSS and the data transfer format without warning the End Consumers.
3. SETTLEMENTS
3.1. Settlements are made in non-cash form in the national currency of Ukraine using payment systems integrated into the Owner's Site.
3.2. The recipient of the payment from the End Consumer is the Site Owner (PP "Liliya Capital") or a financial partner engaged by it. LLC "MOBILITY UKRAINE" does not accept payments from End Consumers under this Contract.
3.3. The final cost of the Ticket may include the Carrier's tariff, the Site Owner's service fee, and payment system commissions.
3.4. Refunds for unused Tickets are made exclusively by the Site Owner in accordance with the Carrier's rules.
4. LIABILITY OF THE PARTIES AND DELIMITATION OF CLAIMS
4.1. The End Consumer is aware that the direct transportation service is provided by the Carrier. The Carrier bears sole responsibility for flight delays, bus quality, and baggage condition.
4.2. The Site Owner (PP "Liliya Capital") is responsible to the User for the correct operation of the Site https://kvytky.com.ua/, the correctness of funds debiting, the timely dispatch of the electronic ticket, and the processing of support service requests.
4.3. Limitation of liability of the Technology Provider: LLC "MOBILITY UKRAINE" is not a party to the ticket purchase and sale contract or the carriage contract. LLC "MOBILITY UKRAINE" bears no responsibility to the End Consumer for financial transactions carried out on the Site, Carrier refusals, schedule changes, non-receipt of tickets, or technical failures on the part of the Site Owner.
4.4. The End Consumer is obliged to direct all claims, lawsuits, and demands for compensation for damages exclusively to the Site Owner (PP "Liliya Capital") or the respective Carrier. The Site Owner has the right to resolve technical issues with the Technology Provider exclusively within the framework of a separate bilateral economic contract.
5. PRIVACY POLICY AND PERSONAL DATA PROCESSING
This section explains how we collect, use, and protect your data when using the Site.
5.1. Data Collection: To issue a Ticket, the Site Owner collects the following User data: First Name, Last Name, phone number, email address, as well as route and travel date data.
5.2. Purpose of processing: Data is collected exclusively for the purpose of generating a travel document, fulfilling the conditions of the carriage contract, communicating in case of schedule changes, and for accounting purposes.
5.3. Transfer to third parties (Sharing): The User consents to the transfer of their personal data:
To the Carrier: for generating the boarding list and providing the travel service.
To the Technology Provider (LLC "MOBILITY UKRAINE"): for transaction routing, electronic ticket generation in the BSS, and technical support of the booking process (data is processed exclusively within the execution of the transaction without the right to use it for marketing purposes without consent).
To Payment Systems: for the secure debiting of funds (the Site Owner does not store full bank card details).
5.4. Data Protection: The transfer of all personal and payment data from the application/site to the servers is carried out in encrypted form using secure communication protocols (HTTPS/TLS).
5.5. User Rights: The End Consumer has the right to access their data, correct it, as well as the right to withdraw consent to processing and request the complete deletion of their data (by sending a request to the Site Owner's E-mail), provided this does not contradict the requirements of tax legislation regarding the storage of transaction information.
6. FORCE MAJEURE CIRCUMSTANCES
6.1. The Parties are exempt from liability for non-fulfillment of obligations under the Contract in the event of force majeure circumstances (war, natural disasters, epidemics, government actions, border closures, etc.) that objectively make the provision of services impossible.
6.2. The Party for which such circumstances have arisen must notify the others within 3 working days.
7. DISPUTE RESOLUTION
7.1. All legal relations arising from this Contract are regulated by the current legislation of Ukraine.
7.2. Any disputes between the End Consumer and the Site Owner shall be resolved through negotiations. If an agreement is not reached, the dispute is submitted for consideration to the appropriate court of Ukraine at the location of the defendant (PP "Liliya Capital" or the Carrier). LLC "MOBILITY UKRAINE" cannot act as a co-defendant in disputes between the User and the Site Owner.
8. TERM OF THE CONTRACT
8.1. The Contract comes into force from the moment of acceptance (payment or booking) by the User and is valid until the Parties fully fulfill their obligations.
9. COPYRIGHTS AND INTELLECTUAL PROPERTY
9.1. All rights to the design, texts, and visual elements of the Site belong to the Site Owner.
9.2. All intellectual property rights to the source code, architecture of the Booking and Sales System (BSS), search algorithms, and databases used on the Site belong exclusively to LLC "MOBILITY UKRAINE".
9.3. The User is prohibited from making unauthorized copying of technologies, parsing the site, interfering with the API, or using the infrastructure of LLC "MOBILITY UKRAINE" for commercial purposes without the direct written consent of the copyright holder.
10. OTHER CONDITIONS
10.1. The Contract number corresponds to the number of the Ticket purchased by the User.
10.2. The main communication channel between the Site Owner and the End Consumer is e-mail or messengers. The User agrees that electronic messages have the same legal force as paper documents.
